Spain Approves Draft Law Banning Vaping on Terraces, Beaches, and Public Spaces

Spain’s Council of Ministers approved a draft tobacco control law on July 21, 2026, that bans smoking and vaping on outdoor terraces (bar and restaurant), beaches, public pools, sports facilities, national parks, work vehicles, and public event venues. The proposal puts e-cigarettes (including nicotine-free devices), heated tobacco, nicotine pouches, hookahs, and herbal inhalation devices under the same restrictions as combustible cigarettes.

The draft also creates 15-meter smoke-free zones around school, hospital, and public building entrances. The legislation updates Spain’s 2005 tobacco law and now heads to parliament, where amendments can be introduced before final approval.

Outdoor café terraces — where Spanish vapers commonly gather — would become off-limits. Nicotine pouches and heated tobacco face the same use restrictions as cigarettes, meaning no use in any expanded smoke-free area. The bill also tightens controls on sales, advertising, and sponsorship of all nicotine products.

Spain’s draft goes further than most EU member states. The EU Parliament recently rejected nicotine tax proposals, but individual countries keep pushing their own restrictions. Spain’s version explicitly extends the ban to nicotine-free devices — a step even stricter than most European proposals.

Spain pulls in over 85 million tourists a year. If you vape or use nicotine pouches there, this law cuts out the places you’d most likely use them: bar and restaurant terraces in the evenings, and beaches during the day.

Travelers should plan to vape only in private residences or designated smoking areas. Check the vape bans by country guide before your trip. Spanish residents can contact their parliamentary representative during the debate period to argue for treating vaping differently from smoking.

Hospitality Industry Fights Back

Restaurant and bar associations have opposed the terrace ban, warning it will push smoking into private homes and hurt businesses that invested heavily in outdoor seating. The hospitality sector argues that treating vaping the same as smoking ignores the evidence submitted to the EU Commission’s nicotine consultation showing vaping carries substantially lower risks than combustible tobacco.

The UK recently proposed plain packaging and display bans for vapes. Hawaii enacted a near-total vape ban. Spain’s draft is now the most comprehensive European restriction proposal to reach a parliamentary vote.

The bill enters parliamentary debate in the coming weeks. Watch for amendments that carve out separate rules for vaping. If the current text passes, expect implementation in late 2026 or early 2027.
