Azerbaijan Moves to Ban E-Cigarettes Entirely, Differentiating from Heated Tobacco Products

Baku, AzerbaijanAzerbaijan’s Milli Mejlis (Parliament) has passed a sweeping ban on e-cigarettes, effectively prohibiting their import, export, production, storage, wholesale, and retail sale, as well as their use. The legislation, finalized in its third and final reading, marks a significant escalation in the country’s regulatory approach to nicotine products and raises questions about the future of harm reduction strategies within the nation.

The amendments to the “Law on Tobacco and Tobacco Products” explicitly categorize e-cigarettes containing nicotine as tobacco products, bringing them under the full scope of existing tobacco control measures. The law defines an e-cigarette as “a product designed to deliver nicotine or nicotine-free vapor into the human body through the respiratory system, intended for use with a device with a mouthpiece or other components, including cartridges and vials, or without them.” The definition also acknowledges the use of refillable vials and disposable cartridges.

Key Distinction: Heated Tobacco Products Exempted

Crucially, the legislation specifically excludes heated tobacco products (HTPs) from the ban. The law defines HTPs as “a product consisting of tobacco (tobacco mixture) and non-tobacco components used in its production, designed to deliver nicotine-containing aerosol into the human body through the respiratory system through a heating process without combustion and without the formation of tobacco smoke.” This differentiation is a key element of the new law and suggests a potential acceptance of HTPs as a less harmful alternative to traditional cigarettes.

The amendments aim to provide greater clarity in the legal classification of tobacco products, particularly in distinguishing between e-cigarettes and HTPs. This is a common challenge for regulators globally as the nicotine landscape evolves. The move also includes corresponding changes to the Tax Code and the Law on Advertising. Notably, “single-use electronic cigarettes” and “liquids for electronic cigarettes” will be removed from the list of excisable goods, effectively eliminating associated taxes. Advertising restrictions will be adapted to reflect the new definitions.

Delayed Implementation and Potential Impact

The ban is not immediate. It is scheduled to come into effect on April 1, 2026. This delayed implementation provides a period for businesses to adjust and potentially liquidate existing stock.

The rationale behind the complete ban on e-cigarettes remains somewhat unclear. While Azerbaijan has historically taken a firm stance on tobacco control, the exclusion of HTPs suggests a nuanced approach.
