Senator Ron Wyden, the ranking Democrat on the Senate Finance Committee, sent investigative letters on August 3 asking Health and Human Services Secretary Robert F. Kennedy Jr., Reynolds American, and kratom maker Botanic Tonics for documents tied to flavored vape and kratom policy changes.
The letters request responses by August 31, 2026. Wyden said the review examines whether political donations influenced enforcement decisions, and his office stressed it has made no finding of wrongdoing.
The probe centers on a timeline. Reynolds American donated $5 million to MAGA Inc. on April 30, a senior Reynolds executive met President Trump on May 2, the administration issued a vape enforcement directive on May 8, and FDA Commissioner Marty Makary resigned on May 12.
Wyden’s office said the letters target “tobacco, vape regulation and related policy changes,” including what the senator describes as eased restrictions on certain flavored vape products. The probe follows state-level flavor restrictions tracked in our state-by-state guide.
The inquiry also covers kratom, a plant-based stimulant sold in smoke shops that is banned in eight states and carries no minimum purchase age in more than a dozen others.
Wyden also alleged that Homeland Security Secretary Markwayne Mullin advocated restrictions on kratom’s synthetic competitors while holding a reported financial stake in Botanic Tonics. The letters request government and corporate communications to determine “whether undisclosed interests influenced policy discussions.”
“From kratom and nicotine to pesticides and PFAS, you have yet to draw a line in the sand and buck corporate interests to Make America Healthy Again,” Wyden wrote to Kennedy. Reynolds American, Botanic Tonics, and HHS have been asked to respond.
Because Wyden is the ranking member on a Republican-controlled committee, he cannot compel testimony or issue subpoenas on his own, so compliance with the deadline is voluntary. No policy change is in effect from the probe alone.
